Offered a temporary contract for your main home in Barcelona? What the 2026 rules say
Under the national rules in force since 8 October 2026, a temporary housing lease must last more than 31 days and, as a general rule, no more than 12 months unless the justified cause continues. It must state a real, verifiable cause in the contract. Without a properly stated cause, it is treated as a regular habitual-residence lease. These rules come from a decree-law that still has to be validated by parliament: check its status before signing. This page describes the rules and what to check; it is not legal advice, and the official texts are the reference.
What the national rules say
The rules are in article 3 of Real Decreto-ley 29/2026 of 6 October, which reforms the LAU, and they apply from 8 October 2026.
- A stated, real cause. A temporary housing lease must expressly state the cause of the tenant's temporary displacement. The cause must be real and verifiable, and the landlord has to prove that it exists. If the contract does not properly state a cause, the lease loses its temporary nature and falls under the habitual-residence rules, retroactively to the signing (LAU art. 7.2, as amended).
- Duration. More than 31 days and, as a general rule, no more than 12 months, depending on the cause. If the cause still exists at the end, the parties can extend by express agreement, again within 12 months in total as a general rule, unless the cause of temporality continues afterwards (LAU art. 9 bis.1).
- Back-to-back contracts. If a temporary lease exceeds 12 months without justification in the cause, or more than two consecutive temporary contracts are renewed or succeed each other between the same parties for the same dwelling, the first one is treated as a habitual-residence lease (LAU art. 9 bis.2).
- Guarantee. In a temporary rental, the additional guarantee cannot exceed one month's rent (LAU art. 36.5). Management and contract-formalization costs are for the landlord, not the tenant (LAU art. 20).
- Rooms. Renting a room or part of a dwelling is covered by the habitual-residence and temporary modalities, and the sum of the rents of simultaneous room contracts cannot exceed the rent of a contract for the whole dwelling.
Catalonia: the law of December 2025 as context
Catalonia has its own law on seasonal and room rentals: the Catalan Parliament passed it on 18 December 2025, regulating seasonal rentals of one to 12 months to stop landlords from dodging the caps on long-term leases (Catalan News, 18 December 2025). According to Idealista, its rules apply from 1 January 2026, temporary and room rentals follow the same price cap as regular residence rentals, and an unjustified temporary contract is treated as a habitual residence (Idealista News, 13 April 2026). The national decree-law keeps a safeguard for regional rules on temporary and room rentals. Read the Catalan text on the Portal Jurídic de Catalunya.
Why it matters in Barcelona in 2026
Temporary listings are still a large part of the market. On Idealista in Barcelona city, temporary listings now exceed 10,000 while long-term listings are just over 5,000 (Idealista News, 16 March 2026). Many renters meet a temporary contract simply because it is what is on offer.
What to check in a temporary contract
- The cause is written in the contract, it is true for you, and you know how it can be verified.
- The duration is more than 31 days and, in general, no more than 12 months in total.
- It is not the third consecutive temporary contract for the same flat with the same landlord.
- The additional guarantee does not exceed one month's rent, and no management or contract-formalization costs are charged to you (BOE, article 36 and article 20).
When it is a warning sign
- A "temporary" or "seasonal" contract for the flat you will live in as your main home, with no cause written in the contract.
- A landlord who offers a temporary contract but will not state the cause.
- A chain of temporary contracts on the same flat with the same landlord.
- A pushy request for money, or for identity documents, before you have visited the flat. See fake listings and fake agency accounts.
What to do next
Read the contract before you pay anything, and compare it with the official texts. Check whether the decree-law has been validated before you sign. To see new long-term listings as soon as they appear, see Barcelona apartments for rent in 2026.
Frequently asked questions
What are the rules for temporary housing leases in Spain in 2026?
Since 8 October 2026, a temporary housing lease must last more than 31 days and, as a general rule, no more than 12 months unless the justified cause continues, and it must state a real, verifiable cause in the contract. Without a properly stated cause it is treated as a habitual-residence lease. These rules come from a decree-law (Real Decreto-ley 29/2026) that still has to be validated by parliament: check its status before signing.
Who can get a temporary rental contract in Barcelona?
Someone whose temporary displacement has a real and verifiable cause stated in the contract; the landlord has to prove that the cause exists. If you are looking for your main home with no such cause, a temporary contract does not fit.
Is a temporary contract for my main home a warning sign?
Yes, if the contract states no real cause. Without a properly stated cause, the lease is treated as a habitual-residence lease, so ask for the cause in writing and read the official texts. This rule comes from a decree-law still to be validated by parliament.
How much additional guarantee can a landlord ask for in a temporary rental?
No more than one month's rent (LAU art. 36.5, as amended by Real Decreto-ley 29/2026, a decree-law still to be validated by parliament). The mandatory deposit (fianza) comes on top of that for housing leases.
What happens after 12 months or after several contracts in a row?
If a temporary lease exceeds 12 months without justification in the cause, or more than two consecutive temporary contracts are renewed or succeed each other between the same parties for the same dwelling, the first one is treated as a habitual-residence lease (LAU art. 9 bis.2, as added by Real Decreto-ley 29/2026).
