Terms of Service

Note: Prio is currently operated as a pre-incorporation project. A formal legal entity is in the process of being established in Spain. These Terms will be updated with the registered company details once incorporation is complete. All obligations and limitations described below are binding and enforceable.

1. Service Description

Prio is a property alert service. We monitor publicly available listing data from real estate platforms (including but not limited to Idealista, Fotocasa, Badi, and others) and send notifications to users when new listings match their defined search criteria.

Prio is a notification service. We do not act as a real estate agent, broker, or intermediary. We do not verify listings, negotiate rents, or participate in rental transactions. Any transaction you enter into based on a Prio alert is solely between you and the listing party.

2. Detection Speed and Performance

Prio detects new property listings ahead of the native push notifications sent by the platforms we monitor. This speed advantage is structural and continuously measured, but it varies depending on conditions.

• Performance objective, not contractual guarantee. The detection speed advantage is a performance objective, not a binding guarantee for any individual listing. Actual detection time varies depending on the listing type, time of day, third-party platform load, and network conditions.
• New listings: Prio typically detects new listings before the platforms send their own push notifications. The typical advantage ranges from a few seconds to several minutes.
• Republications (listings re-promoted by the owner or agent): the detection mechanism works differently for these. Prio makes its best effort to detect and deliver them as quickly as possible, but the speed advantage over the platforms is not guaranteed for this type of listing.
• Coverage: Prio does not guarantee detection of 100% of listings published on any platform. Coverage depends on the geographic zones configured by the user and on the availability of the third-party platforms.

3. Third-Party Platform Dependency

Prio relies on APIs and data from third-party platforms (including Idealista, Fotocasa, and Badi) that it does not control.

• Interruptions, slowdowns, or changes in third-party services may affect the quality, speed, or availability of Prio alerts, either temporarily or for extended periods.
• Prio is not affiliated with, endorsed by, or partnered with Idealista, Fotocasa, Badi, or any other platform it monitors. These names are used for descriptive purposes only.
• In the event of a major disruption, Prio will make its best efforts to restore service as quickly as possible, but no restoration timeline is guaranteed.

4. Network and Infrastructure

• Alert delivery depends on network infrastructure (servers, mobile connections, Telegram service) that may experience interruptions beyond Prio's control.
• Prio uses Telegram as its delivery channel. The availability and latency of Telegram are not under Prio's control.
• Under no circumstances shall Prio be held liable for any damage resulting from a delayed or missed alert.

5. Acceptance of Terms

By using Prio — including interacting with our Telegram bot, visiting our website, or subscribing to a paid plan — you agree to these Terms. If you do not agree, do not use the service.

6. Eligibility

You must be at least 16 years old to use Prio. By using the service, you represent that you meet this requirement.

7. Account and Access

• Access to Prio is provided through Telegram. You are responsible for maintaining the security of your Telegram account.
• You may not share your Prio subscription with others or allow others to use your account for their benefit.
• We reserve the right to suspend or terminate accounts that violate these Terms.

8. Free Trial and Paid Plans

• Free trial: every plan starts with a 7-day free trial. No credit card required. Full access to unlimited priority alerts during the trial period.
• Paid plans: after the 7-day trial, choose a plan to continue. Priority alerts, unlimited searches, additional features as described on our pricing page. Billed monthly.
• Prices may change with 30 days' notice. Existing subscribers will be honored at their current rate until the end of their billing period.
• All paid plans can be cancelled at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.

9. Limitation of Liability

This is important — please read carefully.

• Prio is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Prio provides notifications based on publicly available data. We do not guarantee the accuracy, completeness, or availability of any listing.
• We do not verify whether listings are genuine, whether apartments are available, or whether landlords/agents are legitimate. Always verify listings independently before making any payment or commitment.
• Approximately 37% of listings detected by our system are "ghost listings" — listings that briefly appear but are removed before becoming publicly visible. This is a known characteristic of the platforms we monitor and is not a defect in our service.
• The detection speed advantage is a statistical benefit, not an individual guarantee on any specific listing. The user acknowledges that detection time varies and that Prio cannot guarantee being first on every listing.
• We are not responsible for any loss, damage, or expense arising from your reliance on a Prio notification, including but not limited to rental scams, fraudulent listings, failed transactions, or missed opportunities.
• Prio shall not be held liable for the loss of any real estate opportunity, regardless of the cause — whether due to a delayed alert, a missed listing, a service interruption, or any other reason.
• Our total liability to you for any claims arising from the use of Prio is limited to the fees you have paid us in the 3 months preceding the claim.

10. Service Availability

• We aim for high availability but do not guarantee uninterrupted service. Monitoring may be temporarily interrupted for maintenance, platform changes, or technical issues.
• Real estate platforms may change their systems at any time, which may temporarily or permanently affect our ability to detect new listings. We will make reasonable efforts to adapt but cannot guarantee continuous coverage of any specific platform.
• Alert delivery depends on Telegram's infrastructure. We are not responsible for delays or failures in Telegram's notification system.

11. Acceptable Use

You agree not to:

• Use Prio for any unlawful purpose
• Resell, redistribute, or commercially exploit Prio alerts without our written consent
• Attempt to reverse-engineer, decompile, or extract the technical methods used by Prio
• Use automated tools to interact with our Telegram bot beyond normal usage
• Use Prio data to build a competing service

12. Intellectual Property

The Prio name, logo, website content, and the technical systems underlying our service are our intellectual property. Listing data belongs to the respective platforms and landlords/agents who created it — we claim no ownership over listing content.

13. Governing Law

These Terms are governed by the laws of Spain. Any disputes will be resolved in the courts of Barcelona, Spain. For EU consumers, mandatory consumer protection laws of your country of residence apply where they provide greater protection.

14. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via Telegram or on our website with at least 30 days' notice. Continued use after changes take effect constitutes acceptance.
